Terms of Service

Streamer Garden (“we”, “us”, the “Service”) provides an interactive overlay tool for live streamers, including a control studio, an OBS overlay, and viewer pages where audiences can vote, hype, ask questions, and draw. We may add, change, or remove features at any time.

You must be able to form a binding contract to use the Service, and be old enough to do so in your jurisdiction. If you create a channel or sign in as an owner, you are responsible for safeguarding your owner key and any moderator tokens, and for all activity that occurs under them. Notify us promptly if you believe a key has been compromised.

You agree not to:

• Use the Service to post or display content that is illegal, infringing, harassing, hateful, or sexually exploitative.
• Submit content you do not have the rights to, or that violates someone else's privacy or intellectual property.
• Attempt to break, overload, probe, or circumvent the security, rate limits, or capability controls of the Service.
• Use the Service to distribute malware, spam, or to scrape or harvest data without permission.
• Impersonate others or misrepresent your affiliation in display names or submissions.

Streamers control their own channels and decide what is approved and shown on their broadcast. As a channel owner, you are responsible for moderating audience submissions and for the content that appears on your stream. We provide moderation tools, but we are not responsible for content created by you, your moderators, or your viewers.

You retain ownership of the content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display that content solely as needed to operate and provide the Service (for example, relaying a poll vote or rendering a drawing on an overlay). You represent that you have the rights necessary to grant this license.

If a channel enables donations, payments are handled by a third-party payment provider subject to that provider’s terms. We record donation events to maintain running totals but are not a party to, and are not responsible for, the underlying transactions, refunds, chargebacks, or tax obligations between donors and streamers.

The Service is provided on an “as is” and “as available” basis. We do not guarantee that it will be uninterrupted, error-free, or that live state will always be preserved. We may suspend or discontinue all or part of the Service at any time.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the Service.

You may stop using the Service at any time. We may suspend or terminate access if you violate these terms or use the Service in a way that risks harm to others or to the Service. Provisions that by their nature should survive termination will survive.

We may update these terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of the Service after changes take effect means you accept the updated terms.
